Information about the processing of personal data

We process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the Protection of Individuals with regard to the Processing of Personal Data and on the free movement of such Data (otherwise GDPR).

Personal data

Personal data is information about an identified or identifiable natural person. So, first of all, we are talking about data that allows us to effectively conduct business in accordance with the order assigned to us and attention to your interests. 

In this way, we process the following types of ordinary data: first name, last name, social security number, date of birth, ID card series and number, data (address, email, phone number), financial data and other data that we receive from you or receive in the course of legal assistance provided, if their processing it will be legally acceptable and intentional. 

Depending on the circumstances of the requested case, processing may also be subject to a special category of data, i.e.: data revealing racial or ethnic origin, political views, religious or ideological beliefs, trade union membership and genetic data, biometric data processed to uniquely identify an individual, as well as data on health, sexuality or sexual orientation. orientations. The processing of data relating to convictions and prohibited acts may also be subject to processing on occasion.

Legal basis and purposes of personal data processing

In order to be able to effectively perform the tasks assigned to us, we must process personal data.  

The basis of actions taken by the administrator is the obligation to provide certain services in the legal services contract concluded with him. The legal basis in this regard follows from article 6 (1). b, RODO.

The basis for processing your personal data may also be the legitimate interest of the administrator, resulting from paragraph 1 of Article 6. F of the GDPR, implemented for the following purposes::

  • definition, defense, and claims,
  • processing your requests and requests,
  • maintain reports, analysis, and statistics, and improve the quality of services and services.

The basis for actions is also the fulfillment of the administrator’s legal obligations under Article 6 (1). C of the GDPR, implemented for the following purposes::

  • documentation of contributions in accordance with accounting and tax legislation,
  • fraud detection and prevention of abuse.

Time when personal data is stored

We only store your personal information for as long as it is necessary to achieve this goal. However, the law on the Bar establishes a mandatory period of storage of personal data processed in connection with the profession-the provision of legal services. It is 10 years from the end of the year when the proceedings in which personal data was collected ended. After this period, any personal information is permanently deleted. 

Who can we share your data with?

Depending on the purpose of processing, your data may be transferred to:

  • subjects who process personal data on behalf of the administrator in the framework of services rendered to him, i.e. service providers: in the field of providing and maintaining information, analytical systems, data storage, archiving / destruction of documents, printing correspondence, communications, postal services,
  • bureau of economic information in compliance with the conditions established by law, public and private data sources,
  • organizations that carry out payment activities for the purpose of making payments by you in electronic form, with the purpose of returning them in your favor,
  • other law firms, 
  • state bodies: the prosecutor’s office, courts, police, as well as bailiffs, departments.

Transfer of your personal data to other countries and outside the European Economic Area (EEA)

Whenever possible, we restrict data processing in the EEA area, and at the moment we do not transfer data to third countries. 

Profiling and automated decision-making

Your personal data is not used for automated decision-making and profiling.

User’s rights

With regard to your data processed by our law firm, you have a number of rights and you can enforce them by contacting us. Rights that you have:

  • you have the right to receive information about how we process your personal data collected in the course of conducting the requested case, this information is available in this document (Articles 13-14 of the GDPR).
  • you have the right to access your data that we process and receive a copy of this data (Article 15 GDPR),
  • you have the right to request that outdated data be corrected and supplemented (Article 16 of the GDPR).,
  • you have the right to request the deletion of data that is incorrect or no longer necessary for the purposes for which it was collected (Article 17 GDPR),
  • you have the right to request restriction of data processing under certain conditions (Article 18 of the GDPR),
  • you have the right to transfer data if the administrator processes the data on the basis of your consent or under a contract (Article 20 of the GDPR),
  • you have the right to object to our use of your personal data (Article 21 of the GDPR).

However, please note that in some cases we may not be able to exercise some of the above-mentioned powers if the administrator demonstrates that there are valid, legitimate grounds for processing that exceed the interests, rights and freedoms of the individual, or the administrator submits and demonstrates that there are grounds for establishing, investigating or defending claims.

Objections to our processing of your personal data

If, despite this, you believe that your personal data is being processed illegally, you can file a complaint with the supervisory authority, i.e. the Chairman of the Office for Personal Data Protection located at 2 Stavki str., 00-193 Warsaw
